Introductory Provisions

The owner and operator of the website www.thermona.eu, including applications on subdomains, is the company Thermona, spol. s r.o., with registered office at Stará osada 258, 664 84 Zastávka u Brna, registered in the Commercial Register administered by the Regional Court in Brno, file no. C, insert 413, Company Reg. No.: 13692861 (hereinafter as the “Provider“).

In accordance with Act no. 121/2000 Coll., on Copyright and Rights Related to Copyright and on Amendment to Certain Acts (the “Copyright Act”), as amended, the Provider shall be entitled to exercise proprietary rights pertaining to the website. Furthermore, it owns all the copyrights to the contents posted by the Provider on the website, including any texts, website design, graphics, any depictions on the website, as well as the selection and arrangement of files contained on the website.

The Provider hereby specifies the terms and conditions of use of the website (hereinafter as the “TCs”). The TCs shall apply to anyone (hereinafter as the “User“) who intends to use or uses the Provider´s website.

Website Use

The website shall only be used in a way which is in compliance with legal regulations, good manners, fair trade principles and principles of protecting the good name of the Provider or persons whose data are mentioned on the website.

Information used on the Provider´s website shall be used (downloaded, displayed, printed out, etc.) by the User for personal and non-commercial purposes only. The User shall not be entitled to distribute, process, modify or forward the information or use it for commercial purposes without the Provider´s prior written consent and knowledge. Any copies of the information used shall always contain a notification of the copyrights or other rights or reservations contained therein, or related to the information. The Provider shall not guarantee and shall not bear responsibility for the fact that the use of the information is not in violation of any rights of third parties.

Limitation of Liability and Correctness of Information

The Provider shall make maximum effort to ensure reliability and correctness of any information posted on the website and the content of the website shall be provided to the User “as is”. Nonetheless, minor inaccuracies or typographical errors might occur. Information provided on the website is not binding and is published for reference purposes only. Its nature is informative and general and cannot therefore reflect specific requirements of individual Users. The Provider reserves the right to modify or remove information from the website without prior notice.

Personal Data Protection

The Provider may process personal data of its Users in connection with activities on the website pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data (hereinafter as the “Regulation“) and pursuant to Act no. 101/2000 Coll., on the protection of personal data, (hereinafter as the “Act on the protection of personal data“). User´s communication during certain interactions (especially when sending a request or query thought the web form) is subject to active confirmation of the “Consent to the processing of personal data”:

The Provider cooperates with subjects providing various services to the Provider, especially with service and assembly partners bound by a contract. Such subjects, if entitled to do so, may use the User´s personal data but they shall use such information only when fulfilling their obligations and not for any other purpose. The Provider shall not sell, transfer or disclose personal data to third parties with the intention of damaging the User.

Pursuant to the Regulation and the Act on the protection of personal data, the User may have full knowledge of the processing, handling, protection of its personal data, including the possibility to exercise the right of deletion and access to its personal data. In order to exercise its rights, the User shall contact the Provider´s controller of personal data, either:

  • in writing to the address of the registered office at Stará osada 258, 664 84 Zastávka u Brna,
  • or by e-mail to privacy@thermona.cz.

The Provider´s website tries to protect its Users´ information as much as possible. We consider personal data provided through web forms to be sensitive information and protect them actively both on-line and off-line. While on the Internet, we protect personal data through SSL encryption (HTTPS application), we also do our best to protect our users´ personal data off-line as well. In this mode, we make sure that personal data cannot leave our offices. Consent to allow access to identifiable personal data is only granted to employees who need to know such information in order to carry out a specific task, or to partners bound by a contract.

Information about Cookies

The Provider´s website, as well as most web presentations, may store small data files in the form of cookies in the User´s computer. Cookies are used solely for the purposes of optimization, contents and ads personalization, provision of social media features and website traffic analysis. On its website, the Provider uses short-term cookies, which apply for the duration of the given session and are removed as soon as the browser is closed, and long-term cookies, which remain stored for a longer time.

For the purposes of anonymous statistics, traffic analysis and determination of the method of use of the individual websites, the Provider´s website uses cookies of a third party, the company Google, Inc. (hereinafter as “Google“), namely the Google Analytics service. Google stores such information for a period ranging from 30 minutes up to 2 years, depending on the type of the cookies. Web browsers can prevent acceptance as well as deletion of such cookies. The route to cookies management differs depending on the type of the browser and therefore we recommend that Users should use the browser´s Help and proceed as instructed. In general, cookies management is available in the “Personal Data” section, or in “Privacy Protection“. Blocking all cookies may adversely affect the use of the Provider´s website.

External Links

The Provider´s website may contain external links to other websites which are beyond the Provider´s control. Please note that the Provider does not control or influence the contents of such websites and is not liable for personal data security on such other websites. Likewise, the Provider shall not assume any responsibility for third parties´ websites though which you can reach the Provider´s website.

Final Provisions

Publication of any data or information on the Provider´s website shall not be deemed a legal act establishing a legal relation between the Provider and the User, unless otherwise specified in the individual cases. These TCs shall only be amended or supplemented by the Provider.

The TCs of the use of the website shall take effect as of the date of their publication. These TCs were released on 21. 5. 2018.
